Grandparent’s custody Right is losing its existence

The constitution of United State of America clearly states that the grandparents have no custodial right on their grand children. Although most of the states do give the grandparents some right in certain circumstances, the supreme court of United State of America had given a ruling in regards to the grandparents custody right. As per the ruling child’s custody cannot be provided to grandparent against kid’s parents’ permission. Now states are also making necessary changes in their laws accordingly and making it even harder for the grandparents.  

It is always good to know your rights and limits of the law in your state and of the state your grand child resides in. There are a lot of legal complications you will have to face if you are willing to approach the court in order to exercise your grandparents custody right.  You may have to convince the court with proof that you have been a significant part of your grand child’s upbringing and has been with your child for a sufficient period of time. You are the sole parent of your grand child for at least one year due to separation, divorce or death of child’s parent or the surviving parent is not fit for custody of the child. Unfortunately, both kid and grandparent have to suffer due to the strict laws and disintegration of the family.
